01Who you're agreeing with
xyst.wtf is operated by Kay David Kalex, 53757 St. Augustin, Germany. Full contact details are in the Impressum. Creating an account means you accept these terms.
02Your account
- You must be at least 16 to use xyst.wtf.
- Give a real email address. It's how we verify the account and how you get back in if you lose access.
- You're responsible for what happens under your account. Turn on two-factor authentication in Settings if you want a second lock on it.
- Your username is yours while the account exists. It is not property, it can't be sold, and deleting your account releases it immediately for anyone else to claim.
03Your content
Everything you put on your page stays yours. You keep every right you had in it.
To actually run the service we need your permission to do the obvious things: store your content, convert images and audio into the formats browsers need, and show it to anyone who visits your page. That permission is limited to operating xyst.wtf, is worldwide and royalty-free because the internet is, and ends when you delete the content or your account. We will not sell your content, license it to anyone else, or use it to advertise anything.
You must have the right to post what you post. If it isn't yours and you don't have permission, don't upload it.
04What you can't do
Don't use xyst.wtf to:
- break the law, or host anything that does;
- post sexual content involving minors, or anything that sexualises them — this is reported, not warned about;
- harass, threaten, impersonate or dox anyone;
- host malware, phishing pages or anything designed to deceive a visitor into giving up credentials or money;
- infringe someone else's copyright or trade marks;
- inflate your own view counts — running multiple accounts, scripting visits, or otherwise faking traffic;
- hammer the service with automated requests, work around rate limits, or attack the infrastructure.
We look for the view-count ones automatically and review what turns up by hand. See section 05 of the Privacy Policy for how that works.
05Purchases
Every upgrade is a one-time payment with lifetime access. Nothing renews, nothing is billed again, and there is no subscription to cancel. Prices are on the pricing page.
Payments are taken by Lemon Squeezy, LLC as merchant of record. That means your contract of sale is with them, they handle payment and applicable VAT, and their terms apply to the transaction itself. We receive confirmation that an order happened and unlock the feature; we never see your card details.
What you bought lands on your account as soon as the payment clears. If a payment is refunded, the thing it paid for is removed — and nothing else is.
Right of withdrawal
As a consumer in the EU you normally have 14 days to withdraw from a distance purchase without giving a reason. Because these are digital products delivered immediately, that right lapses once delivery has begun and you have expressly agreed to that and acknowledged the loss of the right — §356(5) BGB. Lemon Squeezy collects that acknowledgement at checkout as part of taking the payment. Withdrawal and refund requests go to Lemon Squeezy, since they are the seller; write to us at [email protected] if you can't get it resolved and we'll help.
06Availability
xyst.wtf is provided as it is. We don't promise it will be available at any particular moment, that every feature will keep working the way it does today, or that nothing will ever be lost. It's run by one person; treat it accordingly and keep your own copy of anything you'd miss.
We may change, add or remove features. If a change removes something you paid for, we'll tell you before it happens.
07Suspension and termination
You can deactivate your page at any time from Settings, which hides it and drops it off the leaderboard while keeping everything intact — signing back in turns it on again. You can delete your account outright from the same place; that is immediate and permanent.
We may suspend or remove an account that breaks section 04. Where it's proportionate we'll say what's wrong and give you a chance to fix it first, but serious cases — illegal content above all — are removed straight away. Losing your account for breaking these terms doesn't entitle you to a refund of a past purchase.
08Liability
We are liable without limit for injury to life, body or health, for damage caused intentionally or by gross negligence, and under the Produkthaftungsgesetz.
For ordinary negligence we are liable only where we breach an obligation that is essential to this agreement and that you are entitled to rely on being met — and then only for the damage typically foreseeable for this kind of contract. All other liability for ordinary negligence is excluded.
Nothing here limits any right you have as a consumer that German law says can't be limited.
09Governing law
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer resident in the EU, this does not deprive you of the protection of any mandatory provision of the law of the country you live in, and you may bring proceedings in your own courts.
We are not obliged and not willing to take part in dispute-resolution proceedings before a consumer arbitration board (§36 VSBG).
10Changes
We'll update the date at the top when these terms change and give notice on the site before a material change takes effect. If you don't accept a change, delete your account — that is the remedy, and it costs nothing.
If any part of these terms turns out to be unenforceable, the rest still stands.
